Terms of Use & purchase.

The important stuff, made clear. These Terms apply when you visit ìmọ̀ Genomics, create an account, purchase a DNA testing kit, submit a sample or use our services. By using ìmọ̀ or placing an order, you agree to these Terms. Nothing here removes rights given to you by UK consumer law.

About ìmọ̀

ìmọ̀ Genomics provides DNA testing and related genetic information services.

Throughout these Terms, “ìmọ̀”, “we”, “us” and “our” refer to ìmọ̀ Genomics.

Who can order

You must be 18 or over to purchase a test for yourself.

If we offer testing for anyone under 18, additional eligibility, parental responsibility and consent requirements may apply.

You must provide accurate information when ordering or registering with us.

Ordering your test

When you place an order, you are making an offer to buy the selected product or service.

We will send you an order confirmation. A contract is formed when we accept your order.

We may decline or cancel an order where reasonably necessary, for example because of payment problems, suspected fraud, incorrect pricing, legal restrictions or an inability to provide the service.

If we cancel an order you have already paid for and no service has been supplied, we will refund the appropriate amount.

Prices and payment

Prices are shown in pounds sterling (£) unless stated otherwise.

The total amount payable, including applicable taxes and delivery charges, will be shown before you complete your purchase.

Payment must be made using one of the payment methods available at checkout.

We may change prices, but this will not change the agreed price of an order we have already accepted.

Delivery

We will send your testing kit to the delivery address you provide.

Estimated delivery times may be shown during checkout or in your confirmation.

Sometimes delays happen outside our reasonable control. If a significant delay occurs, we will explain your options.

Please check your delivery details carefully before ordering.

Your sample

Your DNA starts with your consent.

You must follow the instructions supplied with your kit when collecting, packaging and returning your sample.

By submitting a sample, you confirm that:

the sample is yours, or you are legally authorised to submit it;

the information you have provided is accurate; and

you have provided any consent required for the testing requested.

Do not submit another person's sample without appropriate authority and consent.

When a sample cannot be processed

Occasionally, a sample may not contain enough usable DNA or may otherwise fail our quality requirements.

Where appropriate, we may offer another collection attempt without additional testing charges.

A replacement or repeat test may not be available where the problem results from misuse, failure to follow instructions or circumstances outside the testing process.

We will explain the available options if this happens.

Your results

Genetic testing can provide fascinating information, but it has limitations.

Results depend on factors including sample quality, available reference populations, scientific knowledge, analytical methods and the databases used at the time.

Genetic science continues to develop, which means interpretations may change as knowledge and reference data improve.

Unless a particular test expressly states otherwise, results are provided for personal and informational purposes.

Not medical advice

Information isn't a diagnosis.

Unless we expressly state that a service is clinically validated and provided for a medical purpose, ìmọ̀ results must not be treated as a medical diagnosis or personalised medical advice.

Do not make medical or treatment decisions solely from information provided by ìmọ̀.

Speak to an appropriately qualified healthcare professional if you have concerns about your health or genetic results.

Ancestry and genetic estimates

Ancestry, ethnicity, lineage and population results are estimates rather than absolute statements of identity.

Results may change as reference datasets, scientific methods and understanding develop.

Genetics is only one part of ancestry and identity.

Your results should therefore be understood in the context in which they are provided.

Unexpected discoveries

DNA testing can sometimes reveal information you were not expecting.

This may include information about ancestry, biological relationships, genetic similarities or family connections.

By choosing genetic testing, you acknowledge that unexpected or emotionally significant information may arise.

You should consider this possibility when deciding whether genetic testing is right for you.

Cancelling an order

For purchases made online, you may have a statutory right to change your mind and cancel within the period provided by UK consumer law.

For many goods, this is normally 14 days after receiving them.

Different rules may apply once:

a sealed product has been opened where a lawful health or hygiene exception applies;

a service has begun at your express request;

a service has been fully performed; or

personalised processing or DNA analysis has begun where the applicable law permits an exception.

We will not restrict any cancellation right that UK law gives you.

Returns and refunds

If you are legally entitled to cancel, we will provide the refund required by UK consumer law.

If a product is faulty, damaged, not as described or otherwise fails to meet your statutory rights, contact us.

Where a return is required, we will explain how to send the item back.

Nothing in these Terms limits your statutory rights to a refund, replacement, repeat performance, price reduction or other remedy where UK consumer law provides one.

Once DNA processing begins

DNA testing is different from an ordinary retail purchase.

Once your sample has been received and laboratory processing or analysis has begun, work and costs may already have been incurred specifically for your test.

Any restriction on cancellation or refund after that point will apply only where permitted by law and where the required information and consent have been provided to you.

Your statutory rights remain unaffected.

Your account

If you create an account, you are responsible for keeping your login details secure.

Please tell us promptly if you believe someone has accessed your account without permission.

You must not:

impersonate another person;

create fraudulent accounts;

attempt unauthorised access;

interfere with our security;

introduce malicious software; or

use ìmọ̀ for unlawful purposes.

We may restrict or suspend access where reasonably necessary to protect users, our services or comply with the law.

Your genetic data

Your genetic information is particularly sensitive.

How we collect, use, store, disclose and protect personal and genetic information is explained in our Privacy Notice.

Purchasing a test does not give ìmọ̀ unlimited permission to use your genetic information.

Where separate consent is legally required for a particular use, we will ask for it.

Research

We may invite you to participate in research.

Where participation is optional, you choose whether to take part.

We will provide appropriate information before asking for your consent.

Declining optional research will not affect the ordinary service you have purchased.

Intellectual property

The ìmọ̀ name, branding, website design, text, graphics, software, reports and other original content belong to us or our licensors unless stated otherwise.

You may use your personal results and reports for your own lawful, non-commercial purposes.

You must not copy, reproduce, scrape, commercially exploit or misuse our content, technology or branding without permission.

Using ìmọ̀ responsibly

Please do not use our services to harm others or break the law.

You must not use ìmọ̀ to:

submit samples without appropriate consent;

commit fraud or deception;

harass or discriminate against another person;

attempt unlawful identification or surveillance;

interfere with our technology or security; or

infringe another person's rights.

Serious misuse may result in suspension or termination of access.

Service availability

We work to keep ìmọ̀ reliable and accessible, but no digital service is completely interruption-free.

We may occasionally need to maintain, update or change our systems and services.

We will take reasonable care in providing our services and will not exclude responsibilities that the law says we cannot exclude.

Our responsibility to you

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

If you are a consumer, we are responsible for foreseeable loss or damage caused by our breach of these Terms or failure to use reasonable care and skill.

We are not responsible for losses that were not reasonably foreseeable or for business losses where you purchased the service wholly as a consumer.

Your statutory rights are not affected.

Events outside our control

Sometimes things happen that we cannot reasonably control.

These may include major transport disruption, telecommunications failures, cyber incidents, laboratory disruption, natural disasters, epidemics or government action.

Where such an event affects your order or service, we will take reasonable steps to minimise disruption and tell you where appropriate.

Your statutory rights remain unaffected.

Changes to our services

Science and technology evolve.

We may improve or update our products, reports, analytical methods, reference populations and digital features.

Changes will not remove statutory rights relating to products or services you have already purchased.

Material changes affecting an existing contractual service will be handled fairly and in accordance with applicable law.

Ending your account

You can stop using ìmọ̀ at any time.

You may also request closure of your account, subject to information we are legally required or permitted to retain.

We may suspend or close an account where there has been serious misuse, fraud, security risk or breach of these Terms.

Closing an account does not automatically mean all personal information can immediately be deleted. See our Privacy Notice for more information.

Please include enough information for us to identify your order and understand the issue.

We will aim to deal with complaints fairly and within a reasonable time.

UK law

These Terms are governed by the laws of England and Wales.

If you are a consumer living elsewhere in the UK, you retain any mandatory protections available to you under the law that applies where you live.

Nothing in these Terms prevents you from exercising rights relating to the appropriate courts under applicable consumer law.

If part of these Terms cannot be enforced

If a court or competent authority decides that any part of these Terms is unlawful or cannot be enforced, the remaining Terms will continue to apply.

If we do not enforce a right immediately, that does not mean we have given up that right.

Changes to these Terms

We may update these Terms when our services, technology or legal requirements change.

The latest version will always appear here with its update date.

The terms applying to a particular purchase will generally be those in force when the contract was made, except where a change is required by law or otherwise lawfully agreed.
